Terms and Conditions Last Updated: 21 April 2026 Version 3.0

These terms and conditions form the contract between you and The Embodied Practice Limited (“us”, “we”, etc). By visiting or using Our Website, you agree to be bound by them.

The Embodied Practice is a trade name of The Embodied Practice Limited, company number 9112013, registered in New Zealand.

You are: Anyone who uses Our Website.

Please take a moment to read this agreement. If any part of it doesn’t feel right for you, you’re welcome to reach out before deciding whether to proceed.

Definitions

“Content” means the textual, visual or aural content that is encountered as part of your experience on Our Website. It may include, among other things: text, images, sounds, videos and animations. It includes content Posted by you.

“The Embodied Practice Programmes” means any service we provide, whether through Our Website or otherwise, including workshops, group coaching programmes, 1:1 coaching, and corporate training.

“Post” means display, exhibit, publish, distribute, transmit and/or disclose information, Content and/or other material on Our Website, and the phrases “Posted” and “Posting” shall be interpreted accordingly.

“Services” means all of the services available from Our Website, whether free or charged.

“Our Website” means any website or service designed for electronic access by mobile or fixed devices which is owned or operated by us. It includes all web pages controlled by us.

“Programmes” means the following services offered by The Embodied Practice:

  • Your Nervous System — A Free Evening (introductory talk, no charge)
  • Coercive Control — The Patterns (in-person workshop, $225 per person)
  • Wired for Control (6-week online group coaching programme, $700)
  • 1:1 Coaching — Coercive Control & Your Nervous System (6 sessions, $1,800)
  • Corporate & Organisations Training (full day, $4,500)
Our Contract

These terms and conditions regulate the business relationship between you and us. By purchasing any Programme or using Our Website, you agree to be bound by them.

We do not offer the Services in all countries and may be unable to provide the Services depending on where you are located.

In entering into this contract you have not relied on any representation or information from any source except the definition and explanation of the Services given on Our Website.

Subject to these terms and conditions, we agree to provide to you some or all of the Services described on Our Website at the prices we charge from time to time.

When the Contract Begins

For workshops and free events: The contract between us comes into existence when you register or purchase a ticket.

For the Wired for Control group programme and 1:1 Coaching: The contract comes into existence once the Coaching Agreement has been signed and dated by both parties and payment has been confirmed. The Coaching Agreement will be sent via email once payment has been confirmed. If we are unable to provide a Service we will immediately return your payment.

For Corporate Training: The contract comes into existence once a written agreement has been confirmed by both parties and payment or deposit has been received.

Changes to This Agreement

We may update these terms and conditions from time to time to reflect changes in our services, legal requirements, or business practices.

When we make changes:

  • We will notify you by email at least 30 days before changes take effect
  • Changes will only apply to new bookings or renewals after the notice period
  • If you do not agree to the changes, you may cancel your booking before the service commences without penalty by giving 7 days written notice
  • Continued use of our services after the notice period constitutes acceptance of the new terms

The version that applies to your booking is the version that was in effect when you purchased or registered.

Fee Changes

We reserve the right to adjust fees upon 30 days written notice to you. You may choose to end this Agreement if you do not agree to the fee adjustment by giving 7 days written notice.

Your Account and Personal Information

You are responsible for keeping your account details and password secure. Please let us know immediately if you believe your account has been accessed by someone else.

We ask that you provide accurate and up-to-date information about yourself so we can support you well. We are not responsible for errors resulting from inaccurate information provided to us.

Please notify us of any changes to your information as soon as they occur.

Services

Your Nervous System — A Free Evening

A free introductory talk on nervous system education. No charge. Registration via Humanitix or direct with The Embodied Practice. No refund policy applies as the event is free.

Coercive Control — The Patterns Workshop

A 3-hour in-person paid workshop. $225 per person. Maximum 12 participants.

Payment is required at the time of booking via Humanitix.

A thank you rate of $200 is available to attendees of the free introductory evening, applied via promo code. Valid for 7 days following the free event.

Wired for Control — 6 Week Group Programme

A 6-week live online group coaching programme. $700 per person. Maximum 8 participants per cohort.

Cohort intakes: February, May, August, November.

Payment is required in full prior to the start of the cohort.

Between-session support is provided via a private Facebook group. Email support is available for administrative queries only.

1:1 Coaching — Coercive Control & Your Nervous System

Six individual coaching sessions held online. $1,800 total.

Payment is required in full prior to the first session, or by agreed payment plan confirmed in writing.

Between-session support is provided via email. Response time within 48 hours on business days.

Sessions are 60 minutes each and must be used within 6 months of the start date.

Corporate & Organisations Training

Full-day training for HR leads, people managers, or whole teams. $4,500. Online or in-person. Tailored to your organisation.

A deposit of 50% is required to confirm the booking. The remaining balance is due 7 days before the training date.

Additional Sessions

If you would like additional 1:1 coaching sessions beyond what is included in your package, these can be arranged at the Coach’s discretion at a rate of $300 per session.

No Transfer

Your place in a Programme is personal to you and cannot be transferred to another person without written consent from us.

Prices and Payment

Prices are as set out above for each service and are inclusive of any applicable goods and services tax.

Payment is due prior to the service commencing via Humanitix, bank transfer, or online payment link. Invoices are available upon request.

Bank charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than New Zealand dollar will be borne by you.

You will pay all sums due to us under this agreement without any set-off, deduction or counterclaim.

If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch it to you.

Unused Sessions

Unused sessions do not roll over and cannot be refunded once the cooling-off period has expired.

Refunds and Cancellation

Initial Purchase — 14-Day Cooling-Off Period

You have a 14-day cooling-off period from the date of purchase to cancel for any reason and receive a full refund, provided you have not accessed substantial coaching services during this period.

For 1:1 Coaching packages: if you have attended a session during the 14-day period, the refund will be reduced by $300 per session attended.

To request a refund within this period, please contact us at anna@theembodiedpractice.co.

Workshops

Cancellations made more than 7 days before the workshop date will receive a full refund.

Cancellations made within 7 days of the workshop date are non-refundable. You are welcome to transfer your ticket to another person with written notice to anna@theembodiedpractice.co.

If the workshop is cancelled by The Embodied Practice, a full refund will be issued within 14 days.

Wired for Control — Group Programme

Once the cohort has commenced, no refund is available for the unused portion of the programme.

Corporate Training

The 50% deposit is non-refundable if cancelled within 30 days of the training date.

Cancellations made more than 30 days before the training date will receive a full refund of any amounts paid.

Cancellation by Us

We reserve the right to end this Agreement at any time by giving written notice by email. This would only occur in genuinely exceptional circumstances.

We retain the right, at our discretion, to withdraw Services if we determine that the terms of this agreement have not been met.

Effect of Termination

If the agreement ends for any reason:

  • Your right to use the Services ceases
  • We are under no obligation to forward any unread or unsent messages to you or any third party
  • You remain responsible for any outstanding payments for services already provided

If we end the agreement for reasons other than a breach on your part:

  • We will refund the unused portion of your payment on a pro-rata basis within 14 days
  • You will have reasonable time to download any of your content from our platform

If we end the agreement due to a breach of these terms:

  • No refund will be provided for the unused portion
  • Your access to services ends immediately
Service Interruption or Technical Issues

If we are unable to deliver a session or service due to technical issues on our end, we will reschedule or provide a pro-rata refund — whichever you prefer.

Cancellation and Rescheduling of Sessions

Individual 1:1 Coaching Sessions

Please give at least 48 hours notice if you need to cancel or reschedule a session. This allows the time to be offered to someone else.

Late cancellations (less than 48 hours notice) or no-shows will result in the session being forfeited. We understand that life happens — in genuinely exceptional circumstances such as serious illness or family emergency, this may be waived at the Coach’s discretion.

Live Group Sessions

Live group sessions cannot be rescheduled. If you’re unable to attend, recordings will be made available where possible.

Cancellation by Coach

If the Coach needs to cancel or reschedule a session, you will be given as much notice as possible and the session will be rescheduled at a time that works for both of us.

Between-Session Support

Group Programme: Between-session support is provided via a private Facebook group — a space for reflection, peer connection, and shared resources. It is not a crisis support service.

1:1 Coaching: Between-session email support is available at anna@theembodiedpractice.co. Responses within 48 hours on business days. This is for coaching-related queries and is not a crisis support service.

Crisis Support: If you are in crisis, please contact 1737 (free call or text, NZ) or your nearest emergency service. Crisis resources are also available at theembodiedpractice.co/additional-support and will be shared with you at your first session.

Security of Your Payment Information

Your payment security matters to us. Card payments are processed through Humanitix, Stripe, or another reputable provider — never directly through our website. Our staff and contractors never have access to your card details.

What Coaching Is and Is Not

Nature of Coaching

Coaching is a collaborative, solution-focused partnership. The work we do together is designed to support your understanding of your nervous system and your patterns — at your own pace, in a held space.

Important Boundaries

Coaching is not a substitute for professional mental health care, medical treatment, legal advice, nutritional counselling from a registered healthcare professional, or financial advice.

The Coach is not a licensed therapist, psychologist, psychiatrist, or medical professional.

If at any point it becomes clear that therapeutic or clinical support would serve you better, that conversation will be had with care and without judgment.

The Coach does not provide emergency support or crisis intervention outside of scheduled sessions.

Your Responsibilities as a Client

To get the most from our work together, we ask that you:

  • Attend scheduled sessions on time and ready to engage
  • Participate actively and honestly in the coaching process
  • Complete any agreed actions or reflections between sessions
  • Let the Coach know if something isn’t working or if circumstances change
  • Share any relevant mental or physical health information that may affect the coaching
  • Respect the confidentiality of others in group settings
  • Not share other participants’ personal information or stories outside the group
Your Content and Intellectual Property

Privacy and Confidentiality

Our privacy policy complies with the Privacy Act 2020 and is available at https://theembodiedpractice.co/privacy-policy/.

Both parties agree to keep all information shared during the coaching relationship strictly confidential, except as required by law or as otherwise agreed in writing.

The Coach may disclose your information without consent only where:

  • Required by law or court order
  • There is a serious and imminent risk of harm to you or others
  • The Coach is required to report under mandatory reporting obligations

The Coach may use anonymised and de-identified information from coaching sessions for professional development, training, or supervision purposes.

Content You Share

Anything you share in private sessions or private areas of our platform remains confidential and belongs to you. We will not use it for marketing purposes without your explicit consent.

Content shared in group spaces (such as the Facebook group or group coaching sessions) is visible to other participants. Please be mindful of what you share in those spaces, and know that all participants agree to treat each other’s stories with respect.

Confidentiality in Group Settings

If you participate in the Wired for Control programme, you agree to:

  • Respect the privacy and confidentiality of other participants
  • Not share other participants’ personal information or stories outside the group
  • Participate respectfully and supportively
Limited Licence for Service Delivery

You grant us a limited licence to store and process your content for the purpose of delivering coaching services to you, and to use anonymised data to improve our services. We will only share testimonials or success stories with your explicit written permission.

This licence ends when you close your account, except for anonymised data which cannot identify you.

Coach’s Intellectual Property

The Coach retains all ownership rights to materials, tools, methodologies, and techniques developed as part of this work. This includes all written content, frameworks, blog posts, and educational resources — including those that draw on the Coach’s personal story and experience.

You are welcome to use materials provided for your own personal growth. However, you may not reproduce, distribute, publish, or use them for any commercial purpose without written permission.

You also agree not to use any content from our website or programmes in a way that is defamatory, misleading, or damaging to the reputation of The Embodied Practice or the Coach personally.

Your Responsibilities

You are responsible for:

  • The accuracy of information you provide
  • Ensuring you have the right to share any content you post
  • Respecting other members’ confidentiality in group settings
  • Not sharing content that violates others’ rights or applicable laws
  • Your own progress, decisions, and wellbeing throughout the coaching process

You retain full ownership of your personal content, coaching notes, and reflections. We make no claim to these.

Restrictions on What You May Post to Our Website

We reserve the right to review or moderate Content Posted on Our Website at our discretion.

You agree not to post content that is or may be:

  • Malicious, defamatory, or harmful to any individual or organisation
  • Obscene, offensive, threatening, or violent
  • Sexually explicit or pornographic
  • Deceptive, impersonating, or misrepresenting your identity or affiliation
  • Designed to give the impression of endorsement by us
  • Used to solicit personal information or passwords from others
  • Used for commercial purposes not authorised by us
  • Inaccurate, false, or misleading
  • Age-inappropriate for anyone under 18
Professional Boundaries

The coaching relationship is professional in nature. Both parties agree not to enter into personal, social, romantic, or business relationships outside of the coaching relationship during the term of this Agreement and for 12 months following its end.

The Coach holds the following qualifications and certifications:

Psychology & Coaching

  • Diploma in Psychology & Counselling
  • Trauma-Informed Coach Certification
  • Life Coaching Certification
  • Polyvagal Therapy Certification
  • Acceptance & Commitment Therapy (ACT) Training
  • Hypnotherapy Practitioner Diploma
  • NLP Master Practitioner
  • Certificate in Mental Health
  • Certificate in Criminal Psychology: How Cults Control, Manipulate & Recruit
  • Currently completing: Psychodynamic Psychotherapy Certificate

Somatic & Breathwork

  • 80-Hour NZAB Breathwork Training
  • Currently completing: 400-Hour Breathwork Facilitator Certification (Sacred Breath Academy)
  • Certified Meditation Coach

Nutrition & Culinary

  • Mental Health and Nutrition (University of Canterbury)
  • Professional Chef Training (Level 3 Catering Certificate)

The Coach is committed to upholding the ethical standards of the International Coaching Federation and to maintaining professional standards in all aspects of the coaching relationship.

The Coach holds current professional indemnity insurance appropriate to the Services provided.

Notwithstanding the above qualifications, coaching is not a substitute for licensed mental health treatment, medical advice, or nutritional counselling from a registered healthcare professional.

Liability and Limitations

Our Responsibilities and Limitations

Nothing in this agreement excludes or limits our liability for:

  • Fraud or fraudulent misrepresentation
  • Death or personal injury caused by our negligence
  • Any liability that cannot be excluded under New Zealand law

Consumer Guarantees

Where the Consumer Guarantees Act 1993 applies to services we provide to you, nothing in this agreement limits or excludes the guarantees provided under that Act.

Service Limitations

The Coach provides services in good faith and with reasonable professional care and skill. That said:

  • Coaching is not therapy, counselling, or medical advice
  • We are not responsible for decisions you make based on coaching conversations
  • Results vary by individual and we make no guarantees about specific outcomes
  • You are responsible for your own choices and actions

Technical Services

We will do our best to ensure our website and services are available and running smoothly, but we cannot guarantee uninterrupted access or compatibility with all devices.

Limitation of Liability

Subject to the above, our total liability to you for any loss or damage arising from this agreement is limited to the amount you have paid us in the 12 months immediately before the event giving rise to the liability.

We are not liable for indirect or consequential losses, loss of profits or opportunity, or losses that were not foreseeable to both parties when the contract was formed.

Third-Party Content

We are not responsible for content, links, or services provided by third parties through our website. If something concerns you, please let us know at anna@theembodiedpractice.co.

No Guarantees or Warranties

The Coach makes no guarantees about specific outcomes. The work is collaborative — results depend on your engagement, effort, and application of what you learn.

All implied conditions, warranties and terms are excluded from this agreement to the extent permitted by applicable law.

Storage of Data and Session Interruptions

We take reasonable care with data storage but cannot be held responsible for the deletion or failure to store or deliver email or other messages.

Occasionally we may need to suspend access to Our Website for maintenance or repairs. We will give notice where possible.

Force Majeure

For the purpose of this clause, “Force Majeure Event” means an event beyond a party’s reasonable control that adversely impacts their ability to comply with obligations under this Agreement, including but not limited to: fire, flood, natural disasters, civil commotion, industrial action, war, pandemic, epidemic, and restrictions by government authorities.

If a party is unable to perform an obligation because of a Force Majeure Event, that party must notify the other, is temporarily relieved of the affected obligations, and must take all reasonable steps to minimise the impact.

Neither party is excused from any obligation to pay money because of a Force Majeure Event.

If a delay arising from a Force Majeure Event continues for more than 3 months, either party may end this Agreement by giving 14 days written notice.

Complaints and Disputes

If You Have a Complaint

We take all feedback seriously and want to know if something hasn’t felt right. Please reach out:

  • Contact us at anna@theembodiedpractice.co with details of your concern
  • We will acknowledge your complaint within 2 business days
  • We will investigate and respond within 10 business days
  • If more time is needed, we will keep you updated throughout

Dispute Resolution

If a dispute arises that we haven’t been able to resolve informally:

Initial Notification: The party raising the dispute must give written notice detailing the nature of the dispute, the desired outcome, and the action required to settle it.

Good Faith Negotiation: Both parties will attempt to resolve the matter through good faith discussion.

Mediation: If unresolved after 21 days, the parties will agree on a mediator. Any mediation will be held in Auckland, New Zealand. Costs are shared equally.

All communications during this process are confidential and treated as “without prejudice”.

If mediation does not resolve the matter within 30 days, either party may pursue legal proceedings.

Nothing in this process affects your rights under New Zealand consumer protection law or your right to seek legal advice.

Security of Our Website

We ask that you use Our Website respectfully and as intended.

You agree not to:

  • Modify, copy, or cause damage to any portion of Our Website or its software
  • Link to Our Website in a way that misrepresents or distorts how it appears
  • Download any part of Our Website without express written consent
  • Collect or use product listings, descriptions, prices, or other content except as intended
  • Aggregate or duplicate any Content or information from Our Website beyond what is reasonably necessary
  • Share login credentials with any third party

You are welcome to:

  • Create a hyperlink to Our Website to promote a shared interest, provided it does not misrepresent us or our work
  • Copy text from any page for your own personal use in connection with our Services
Relationship of the Parties

We are independent contracting parties. Nothing in this Agreement creates an employment, partnership, agency, or joint venture relationship between us.

Miscellaneous Provisions

Severability

If any provision of this Agreement is found to be void or unenforceable, it will be limited or severed as necessary, and the remainder of the Agreement will continue in full force.

Entire Agreement

This Agreement (together with any signed Coaching Agreement) is the entire agreement between the parties and supersedes all prior discussions, whether oral or written.

Amendment

This Agreement may be modified only in writing, signed by both parties, or as provided in the “Changes to This Agreement” section above.

Assignment

The rights and obligations of the parties set out in this agreement shall pass to any permitted successor in title.

Waiver

No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.

Notices

All notices under this Agreement should be in writing and sent by email to:

Client: The email address provided during registration

Notices are deemed received within 24 hours of sending by email, provided no notice of non-receipt has been received.

Counterparts

This Agreement may be executed in counterparts, each of which constitutes an original, and all of which together form one agreement.

Rights of Third Parties

This agreement does not give any right to any third party under the Contract and Commercial Law Act 2017 or otherwise, except that any provision which excludes or restricts the liability of our directors, officers, employees, subcontractors, agents and affiliated companies may be enforced under that Act.

Jurisdiction and Governing Law

This Agreement is governed by the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the New Zealand courts in connection with matters arising under this Agreement.
